On January 27, a student was hit by a car at the 27200 block of 72nd Avenue N.W. in Stanwood. The student was crossing the street in a crosswalk on her way to Stanwood High School when she was hit. Although the driver was not believed to be speeding, it was dark, raining and near the school.

RCW 46.62.261 requires that all drivers shall yield the right of way to any pedestrian. Therefore, injured pedestrians may not be barred from recovering damages when drivers were following posted speed limits. Pedestrians struck by motor vehicles may not only recover under the driver’s liability policy, but also the driver’s personal injury protection (PIP) policy.
