A 39-year-old Bellevue man and a 24-year-old woman from Gold Bar were injured when the sport-utility-vehicle they were riding in collided Thursday with a state Department of Transportation (DOT) truck on Interstate 90 near Issaquah.
The collision took place about 12:20 a.m. in the eastbound lanes of I-90 near West Lake Sammamish Parkway Southeast, the State Patrol reported.
A DOT crew was doing maintenance in the closed left three lanes when a 2000 Ford Expedition failed to stop and collided with a DOT attenuator, or barrier, truck being used to protect work crews.
The woman, who was not wearing a seat belt, was riding in the passenger seat of the Ford and was thrown through the windshield of the SUV onto the DOT truck. She was dragged about 100 feet and was taken to Harborview Medical Center, where she was in serious condition. The driver was wearing a seat belt and was injured and taken to Harborview. Information about his condition was unavailable.
Two major thoughts: (1) it may be that both have claims against the DOT or, in the alternative, (2) the passenger has a claim against the driver despite the fact she was not wearing a seatbelt.
