In December, two workers from Guatemala were killed in a van accident in Washington state. These types of van accidents are not rare. Since 2002, 23 migrant workers have died in van accidents. Due to their independent employee status, the employer provides no benefits to any of these migrant workers for their injuries or to their families in the case of death.

The families of the victims have a potential claim against the at fault driver(s) for their losses. In addition, injured workers may file a claim with the Department of Labor to obtain employee status and gain access to the benefits owed to employees in the state of Washington.
