Pierce County Superior Court Judge Rosanne Buckner recently ruled that the Washington Department of Transportation must give back pay to ferry workers who were forced to work overtime without pay during the last four and a half years. The workers are part of a class action lawsuit brought on behalf of ferry engineers and oilers. The employees had not previously been paid for safety training time outside of their shifts.

In total, the class of 300 employees is entitled to approximately $8 million. Attorneys for the Department of Transportation indicated that they would appeal.

Washington law provides that any employer who fails to pay an employee wages is liable for twice the amount of wages together with the employee’s costs and attorney fees. RCW 49.52.070.
